What is Employment Sponsored Visa?

 

This visa lets skilled workers who are nominated by their employer live and work in Australia permanently. The Labour Agreement stream might be for you if you currently work, or will work, for an employer who is party to a labour agreement. Employer sponsorship isn’t one-size-fits-all. There are many visa options available and it is important to select the right visa subclass for both the business and the individual being sponsored. Employer-sponsored visas range from training visas through to permanent residency.

The main benefits of this visa are you can work full-time in your nominated position and have the chance to gain Permanent Residency after working. You are also able to include your family (spouse and child) in the application with you.

Overview 

 

Employer Nomination Scheme (ENS) visas, or subclass 186 visas, are permanent residency visas for skilled workers. They are available both to applicants who are already living and working in Australia as temporary residents, and to those living outside Australia. To be eligible for this visa, a skilled individual must be be nominated by an Australian employer. 

The Subclass 186 Visa has 3 streams:

  • the Direct Entry stream
    For applicants who are qualified or have sufficient experience in an eligible occupation. See the Direct Entry Stream tab for specific requirements.

  • Temporary Residence Transition Stream (TRT)
    For 457 visa or 482 TSS Visa holders who have worked for their nominating employer for a minimum of two or three years. See the Transition Steam tab for specific requirements.

  • the Labour Agreement stream
    For applicants who are sponsored by an employer under a labour agreement.

Basic Visa Requirements Checklist

 

You must:

  • have an occupation on the Medium- and Long-term Strategic Skills List

  • receive an IELTS (or equivalent test) score of 6.0 in each component

  • be less than 45 years old at the time of application

For direct entry:
You must:

  • obtain a valid skill assessment for your nominated occupation

  • have at least 3 years’ full-time work experience in your nominated occupation

For the TRT stream:
You must:

  • have worked full-time on your 482 Visa for at least 3 of the 4 years prior to applying for this stream

  • currently hold a 457 or 482 or a Bridging visa A, B or C

Temporary Skill Shortage Visa
Subclass 482

Overview

To meet the workforce demands in Australia, employers sponsor foreign-national applicants as necessary to fit in the particular position. The TSS visa is a temporary visa that allows the holder to live and work in Australia for 2-4 years based on the employer's requirement. Applicants may include their dependents while applying for a TSS visa. This visa has two streams: applicants with occupations on the Short-Term Skilled Occupations List (STSOL) are eligible to work and live in Australia for two years. The Medium and Long-Term Strategic Skills List (MLTSSL) are eligible to work for four years and can apply for Australia PR after three years.

The Subclass 482 Visa (TSS) has 3 different streams

  • Short-Term Stream – two years for each visa, can apply twice: For a short-term stream, your employer nominated you for a position in the short-term skilled occupation list- STSOL (see the list).

  • Medium-Term Stream – up to four years: For a medium-term stream, you must be nominated for a profession in the medium-skilled occupation list- MLTSSL (see the full list).

  • Labour Agreement Stream: For a labour agreement stream, your occupation must be included in the labour agreements between the Government of Australia and your sponsor. Your sponsor must be a part of the labour agreements.

Eligibility Criteria for a Visa 482

  • You are nominated for a job position by an eligible employer.

  • You are employed in your nominated profession and worked for your nominator.

  • You have worked in your nominated occupation for at least 2 years before applying for a 482 visa.

  • You have a substantive visa or a Bridging Visa A (BVA), a BVB or a BVC (if you apply from Australia).

Steps for receiving a TSS Visa 

  1. A sponsorship application by the employer

  2. A nomination application by the employer

  3. A visa application by the applicant

Short-Term Stream

The short-term stream is designed for employers to fill a genuine temporary skill shortage with skilled workers from overseas. This stream allows employers to sponsor overseas workers for a period of up to two years, with the possibility of an extension for a further two years. To be eligible for the short-term stream, the occupation must be listed on the Short-Term Skilled Occupation List (STSOL).

To apply for a TSS visa under the short-term stream, the applicant must meet the following requirements:

  1. Have a formal job offer from an approved Australian employer for an occupation on the STSOL

  2. Meet the skill level requirements for the nominated occupation

  3. Have at least two years of work experience in the nominated occupation or a related field

  4. Meet the English language proficiency requirements

  5. Meet the health and character requirements

  6. Be able to demonstrate that they have the necessary qualifications and/or licenses to perform the nominated occupation

Medium-Term Stream

The medium-term stream is designed for employers to fill medium-term critical skills shortages with highly skilled workers from overseas. This stream allows employers to sponsor overseas workers for a period of up to four years, with the possibility of an extension for a further four years. To be eligible for the medium-term stream, the occupation must be listed on the Medium and Long-Term Strategic Skills List (MLTSSL).

To apply for a TSS visa under the medium-term stream, the applicant must meet the following requirements:

  1. Have a formal job offer from an approved Australian employer for an occupation on the MLTSSL

  2. Meet the skill level requirements for the nominated occupation

  3. Have at least two years of work experience in the nominated occupation or a related field

  4. Meet the English language proficiency requirements

  5. Meet the health and character requirements

  6. Be able to demonstrate that they have the necessary qualifications and/or licenses to perform the nominated occupation

 

In addition, the sponsoring employer must demonstrate that they have a genuine need for the overseas worker and that they have made reasonable efforts to recruit Australian workers before offering the position to an overseas worker.

One of the advantages of the medium-term stream is that it provides a pathway to permanent residency through the Direct Entry stream of the Employer Nomination Scheme (ENS) or the Regional Sponsored Migration Scheme (RSMS) if the applicant meets certain criteria. This pathway requires the applicant to work for the sponsoring employer for a period of three years before they can apply for permanent residency.

 

Labour-Agreement Stream

A labor agreement is a formal agreement between the Australian government and an employer or group of employers. It allows them to access a range of visas, including the TSS visa, to fill skilled positions that cannot be filled by Australian workers. Labor agreements are designed to address skill shortages in specific industries or regions.

To apply for a TSS visa under a labor agreement, the applicant must meet the following requirements:

  1. Have a formal job offer from an Australian employer who is party to a labor agreement with the Australian government

  2. Meet the skill level requirements for the nominated occupation as specified in the labor agreement

  3. Meet any other eligibility criteria specified in the labor agreement, such as English language proficiency, qualifications or work experience

  4. Meet the health and character requirements

In addition, the sponsoring employer must demonstrate that they have a genuine need for the overseas worker and that they have made reasonable efforts to recruit Australian workers before offering the position to an overseas worker.

The requirements for a TSS visa under a labor agreement may differ from the requirements for the standard TSS visa. This is because the labor agreement stream is designed to address specific skill shortages in particular industries or regions.

 

 

Skilled Employer Sponsored Regional (Provisional) Visa Subclass 494
 

The Skilled Employer Sponsored Regional (Provisional) Visa Subclass 494, is a temporary visa that allows skilled workers to live and work in regional Australia for up to five years. This visa is designed to address skill shortages in regional areas of Australia and encourages migrants to settle in regional areas permanently.

To be eligible for the 494 visa, the applicant must meet the following requirements:

  1. Have a job offer from an employer located in a designated regional area of Australia

  2. Have the necessary skills, qualifications, and English language proficiency for the nominated occupation

  3. Be under the age of 45 at the time of application

  4. Meet the health and character requirements

In addition, the sponsoring employer must meet certain requirements, including:

  1. Be located in a designated regional area of Australia

  2. Have a genuine need for the nominated position

  3. Have a good record of compliance with Australian laws

  4. Meet any other requirements set out by the Australian government

The 494 visa application process includes the following steps:

  1. The employer must apply to become a standard business sponsor and be approved by the Australian government.

  2. The employer must nominate the skilled worker for a specific occupation.

  3. The skilled worker must apply for the RSMS visa and provide evidence that they meet the eligibility criteria.

The 494 visa has three streams:

  1. The Employer Sponsored stream is for skilled workers who have been sponsored by an Australian employer with a genuine need for their skills in a designated regional area.

  2. The Labor Agreement stream is for skilled workers who are sponsored by an employer through a labor agreement with the Australian government.

  3. The Subsequent Entry stream is for family members of RSMS visa holders who wish to join them in Australia.

The Skilled Employer Sponsored Regional (Provisional) Visa Subclass 494 is a temporary visa that allows the visa holder and their family members to live and work in regional Australia for up to five years. After three years of holding the 494 visa, the visa holder may be eligible to apply for permanent residency through the subclass 191 visa.

It is important to note that the Australian government regularly updates the list of designated regional areas, so it is important to check the latest information before applying for the RSMS visa.

Training Visa Subclass 407

The Training visa, subclass 407, is a temporary visa designed for individuals who wish to undertake workplace-based training in Australia. This visa is suitable for those who want to gain workplace experience, enhance their skills, or undertake professional development activities.

The Training visa, subclass 407, has two streams:

  1. The Occupational Trainee stream is for individuals who are sponsored by an employer to participate in a structured training program that is related to their occupation or field of expertise.

  2. The Professional Development stream is for individuals who are participating in a professional development program that is not related to their occupation or field of expertise.

To be eligible for the Training visa, the applicant must meet the following requirements:

  1. Have a genuine reason for travel to Australia that aligns with one of the two streams of the visa.

  2. Have adequate financial resources to support themselves while in Australia.

  3. Have adequate health insurance while in Australia.

  4. Meet the health and character requirements.

  5. Have a relevant sponsor who is willing to provide training or professional development opportunities.

The application process for the Training visa, subclass 407, involves:

  1. Identifying the relevant stream of the visa that aligns with the intended training or professional development activities in Australia.

  2. Gathering the necessary documentation, such as passport, financial statements, health insurance, and supporting documents for the intended training or professional development activities.

  3. Applying for the visa online or through a registered migration agent.

  4. Paying the visa application fee.

  5. Attending any necessary interviews or medical examinations.

The Training visa, subclass 407, is a temporary visa that allows the visa holder to stay in Australia for the duration of the approved training or professional development program, which can range from a few months to two years. It is important to note that the Training visa cannot be used as a pathway to permanent residency in Australia.

Temporary Activity Visa Subclass 408

The Temporary Activity visa, subclass 408, is a visa designed for individuals who wish to travel to Australia for a short-term, specific purpose or activity.

 

This visa is suitable for those who want to participate in a range of activities including:

  1. Cultural or social events

  2. Sporting events or competitions

  3. Short-term work opportunities or internships

  4. Religious or charitable activities

  5. Research or academic opportunities

  6. Entertainment or music events

The Temporary Activity visa, subclass 408, has four streams:

  1. The Invited Participant stream is for individuals who have been invited to participate in an event or activity in Australia.

  2. The Australian Government Endorsed Event stream is for individuals who are invited to participate in a government-endorsed event or activity.

  3. The Special Program stream is for individuals who are participating in an approved special program that involves cultural exchange, youth mobility, or international relations.

  4. The Superyacht Crew stream is for individuals who are employed as crew members on board a superyacht that is traveling to or around Australia.

To be eligible for the Temporary Activity visa, the applicant must meet the following requirements:

  1. Have a genuine reason for travel to Australia that aligns with one of the four streams of the visa.

  2. Have adequate financial resources to support themselves while in Australia.

  3. Have adequate health insurance while in Australia.

  4. Meet the health and character requirements.

The application process for the Temporary Activity visa, subclass 408, involves:

  1. Identifying the relevant stream of the visa that aligns with the intended activity in Australia.
