What is the AAT?


The Administrative Appeals Tribunal (AAT) is an independent body that reviews decisions made by the Department of Home Affairs.It assesses whether the original decision was fair, lawful, and correctly applied under migration law.

  • Insufficient or inconsistent documents and evidence

  • Failure to meet Genuine Temporary Entrant (GTE) or Genuine Relationship criteria

  • Lack of financial proof

  • Invalid English test results or expired health checks

AAT Review Process


  1. Receive Decision Letter – You’ll be notified of your refusal or cancellation.

  2. Check Review Rights – Not all refusals are reviewable; AAT jurisdiction must apply.

  3. Lodge Appeal – File an appeal within 21 or 28 days, depending on your case type.

  4. Prepare Evidence – Collect new documents, statements, and legal submissions.

  5. Attend AAT Hearing – Present your case, either in person or online.

  6. Await Decision – The AAT may affirm, vary, or overturn the Department’s decision.
